Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Treadmill Assistant ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. License

The App is licensed, not sold, to you. Subject to your compliance with these Terms, the developer grants you a limited, non-exclusive, non-transferable, revocable license to use the App on devices that you own or control. You may not distribute or make the App available over a network where it could be used by multiple devices at the same time. You may not rent, lease, lend, sell, redistribute, or sublicense the App. You may not reverse-engineer, disassemble, or decompile the App, except to the extent permitted by applicable law.

3. Description of Service

Treadmill Assistant is an unofficial third-party application that connects to FitShow and FTMS-compatible treadmills via Bluetooth. The App allows users to monitor treadmill data, control treadmill settings, create workout programs, and sync workout data to Apple Health (iOS) or Health Connect (Android).

Note

The App is NOT affiliated with, endorsed by, or supported by any treadmill manufacturer. The App is developed independently and has no official connection to FitShow, your treadmill brand, or any equipment manufacturer.

4. "AS IS" Disclaimer and No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

The developer makes no guarantees regarding accuracy, reliability, availability, or compatibility with your treadmill or devices. The App may contain bugs or behave unpredictably, and features may change without notice.

5. Assumption of Risk

You exercise at your own risk and assume all risks associated with using this App and your treadmill, including physical injury, equipment issues, and data loss.

Consult your physician before beginning any exercise program. You are responsible for using proper safety equipment, monitoring your treadmill during use, and stopping immediately if anything seems wrong.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, the App developer and affiliates shall not be liable for any injury, property damage, or other damages arising from use of the App, regardless of legal theory.

Some jurisdictions do not allow limitation of liability for certain damages. In such jurisdictions, liability shall be limited to the maximum extent permitted by law.

7. Indemnification

You agree to indemnify and hold harmless the App developer and affiliates from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

8. User Responsibilities

You are responsible for testing App features before regular use, monitoring your treadmill during use, using the emergency stop, and maintaining your equipment in safe working condition. The developer cannot verify your treadmill's condition or guarantee compatibility with your specific equipment.

9. Safety Key and Emergency Stop

Always use your treadmill's physical safety key/clip and keep the emergency stop within reach. Physical safety features on your treadmill take priority over App features.

10. Custom Workout Programs

You may create custom workout programs. You are responsible for ensuring any programs you create are safe and appropriate for your fitness level. Test new programs at low speeds before regular use.

11. Subscriptions and Payment

Subscription Requirement

Treadmill Assistant offers a free tier that includes treadmill connection, speed and incline control, free-run workouts, and basic workout history. A Premium subscription is required to access advanced features such as custom programs, ad-hoc targets, health sync, cloud backup, and more.

Subscription Plans and Pricing

Two subscription options are available: Monthly and Yearly. Both provide full access to all features. Pricing is displayed in the App and may vary by region and currency.

Billing and Auto-Renewal

By purchasing a subscription, you acknowledge that your subscription has recurring payment features and you accept responsibility for all recurring charges until you cancel.

  • Payment is charged to your Apple ID (iOS) or Google account (Android) at confirmation of purchase
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan
  • You can manage and cancel subscriptions in your Apple ID account settings (iOS) or Google Play Store (Android) after purchase

Free Trials

If offered, free trials provide full access to Premium features for the specified trial duration. Any unused portion of a free trial is forfeited when you purchase a subscription. Only one free trial per Apple ID or Google account.

Cancellation

You may cancel your subscription at any time through your Apple ID account settings (iOS: Settings > Apple ID > Subscriptions) or Google Play Store (Android: Profile > Payments & subscriptions > Subscriptions). Cancellation takes effect at the end of the current billing period. You retain access to Premium features until the end of your paid period. No refunds or credits are provided for partial billing periods.

Refunds

All purchases are processed by Apple (iOS) or Google (Android). To request a refund, visit reportaproblem.apple.com for iOS purchases or Google Play support for Android purchases. The developer cannot process refunds directly.

Price Changes

Subscription prices may change. You will be notified in advance of any price increases in accordance with Apple's policies. Continued use of the subscription after a price change constitutes acceptance of the new price.

12. Third-Party Services

The App may integrate with third-party services including:

  • Apple App Store / Google Play Store: For subscription and payment processing
  • Apple Health / Health Connect: For workout data synchronization
  • iCloud / Google Drive: For data backup and sync across devices
  • Google Sign-In: On Android, for authenticating Google Drive access
  • Bluetooth: For treadmill communication

Use of these services is governed by their respective terms and privacy policies. The developer is not responsible for third-party service availability, accuracy, or security.

13. Privacy

The App does not collect or transmit personal data to external servers. All data is stored locally on your device and in your personal cloud account (if enabled). See the Privacy Policy for details.

14. Modifications to Terms

The developer reserves the right to modify these Terms at any time. Material changes will be indicated by updating the "Last Updated" date. Continued use of the App after changes constitutes acceptance of the modified Terms.

You may be required to re-acknowledge these Terms periodically or after significant updates.

15. Termination

You may stop using the App at any time by uninstalling it. The developer may discontinue the App or any features at any time without notice.

16. Export Compliance

You may not use or export the App except as authorized by United States law and the laws of the jurisdiction in which the App was obtained. The App may not be exported or re-exported to any U.S.-embargoed countries or to anyone on the U.S. Treasury Department's Specially Designated Nationals List or the U.S. Department of Commerce's Denied Persons List or Entity List.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Poland, without regard to conflict of law principles. For users in the European Union, mandatory consumer protection laws of your country of residence shall apply to the extent they provide greater protection.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms, together with the Privacy Policy and any in-app agreements (such as the liability waiver for treadmill control), constitute the entire agreement between you and the developer regarding the App.

20. No Waiver

Failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
